Aurora Gold and Silver, LLC
Shipping and Insurance Terms for Sellers

Effective Date: 09/11/2024

1. Self-Shipping with Customer-Provided Labels
Sellers have the option to ship items to Aurora Gold using their own shipping labels and carriers. By choosing this option, the Seller accepts full responsibility for the shipment, including any loss, damage, or delays during transit. Aurora Gold will not provide insurance or assume any liability for shipments made with customer-provided labels. It is the Seller’s responsibility to ensure adequate insurance coverage and proper packaging when not using Aurora Gold’s provided labels.

2. Shipping with Aurora Gold’s Provided Insured Label
Sellers opting to use the insured FedEx shipping label provided by Aurora Gold via QR Code agree to the following terms:

  • Insurance Coverage: The provided label includes insurance coverage facilitated through IFS Inforsure Inc., covering the replacement value of items during transit. Coverage and claims are subject to IFS Inforsure’s insurance policy terms, including all limitations and exclusions outlined therein.
  • Coverage Limitations and Exclusions: Insurance does not cover losses due to insufficient packaging, unauthorized shipping methods, drop-offs at unauthorized locations, acts of war, fraud, and other exclusions specified by IFS Inforsure. Coverage is valid only from the point of acceptance by an approved carrier until delivery to the designated address with the required signature, where applicable.
  • Packaging Requirements: Sellers must use at least two hard boxes for shipping (e.g., items placed inside a bubble mailer, then inside a FedEx Small Box, and finally inside a FedEx Medium Box). The outer box must be new and securely taped on all edges.
  • Drop-off Locations: Shipments must be dropped off at approved FedEx locations, such as FedEx Office Print & Ship Center or FedEx Ship Center. Unauthorized drop-offs, including unmanned drop boxes and third-party collection points, are prohibited and will void insurance coverage.
  • Documentation: Each parcel must include a piece of paper with the Seller’s legal name, phone number, and a detailed declaration of value of the itemized contents.

3. Insurance Limits

  • Maximum Coverage: The maximum coverage per shipment is limited to $250,000 per address per day. Shipments with no declared value will have a maximum insured value of $100. Insurance coverage for items shipped to residential addresses is capped at $4,999 unless otherwise approved in writing by Aurora Gold.
  • Excess Value: Any insurance coverage exceeding the $250,000 limit per address per day is considered null and void. For items shipped without a declared value, insurance will default to a maximum of $100.

4. Responsibilities and Liability

  • Seller’s Responsibility: The Seller is responsible for complying with all packaging, shipping, and documentation requirements. Non-compliance may void insurance coverage. Sellers who use their own labels assume all risks associated with shipment, including the responsibility for any damage, loss, or delays.
  • Aurora Gold’s Liability: Aurora Gold’s liability is limited to the extent of the insurance coverage facilitated by IFS Inforsure Inc. Aurora Gold is not liable for losses occurring outside the scope of coverage, including exclusions outlined in the insurance policy. Aurora Gold does not guarantee the performance of the insurer or the carrier and is not responsible for their actions or omissions.

5. Claims Process

  • Reporting Claims: Claims for loss or damage must be reported to Aurora Gold within 24 hours of receiving notification of loss and no later than 15 days from the shipping date. Failure to report within this timeframe may nullify coverage.
  • Cooperation in Claims Process: Sellers must cooperate fully in the claims process, including providing all required documentation, statements, and participation in examinations under oath if requested by the insurer. Non-cooperation will result in nullification of coverage.
  • Claims Decision: All claims decisions are made by the insurer or its authorized claims agent. Aurora Gold is not responsible for claims decisions or payouts made by the insurer.

6. Indemnity and Legal Compliance

  • Indemnity: Sellers agree to indemnify and hold Aurora Gold harmless from any losses, claims, or damages arising from their breach of these terms or failure to comply with applicable laws and regulations.
  • Governing Law: These terms are governed by the laws of the State of Illinois, and any disputes shall be resolved exclusively in the courts of Kane County, located in Aurora, Illinois. Both parties consent to this jurisdiction and waive any objections to the venue, including claims of inconvenience.

7. Amendments to Terms
Aurora Gold reserves the right to amend these terms at any time. Any changes will be effective immediately upon posting on Aurora Gold’s website or as otherwise communicated to the Seller.
